Limited 1 Year Manufacturer Defects & Damage Replacement Warranty
What This Warranty Covers
Bluehouse Ski Co, LLC doing business as Bluehouse Skis and FactoryDirectSkis.com (“us”, “we”, “our”) stands behind all the products we make. That is why we offer a very generous warranty on all of our ski products. We warrant to the original purchaser that our products will be free from any defects in material or workmanship for a period of one (1) year from the date of purchase. If you are having any problem whatsoever with your products, please contact us as soon as possible so we can help resolve any issues. Your satisfaction with our products is our greatest concern. And rest assured that you not receive the run around or any hassle in dealing with a warranty issue. If you purchased our skis second hand on Craigslist, through a ski swap, off your buddy (meaning you were not the original purchaser), we are sorry this warranty does not cover your product.
Additionally, if you damage your skis to the point that they are unskiable or your ability to ski them has been significantly impaired due to unintentional damage (not stemming from a manufacturer defect), we will allow you to purchase one (1) replacement pair of skis during the warranty period for $200. Approval of your warranty claim is subject to our review and approval and is left to our sole discretion. Damage replacement skis are not covered by this warranty.
What This Warranty Does Not Cover
This limited warranty on manufacturing defects does not cover abnormal use or misuse of our products (i.e. use on cement, concrete, asphalt, metal rails, wooden boxes, or the like), or damage caused by accidents, impact on rocks, stumps, rails, boxes, or other manmade objects, alteration, neglect, abuse, abrasion, chemicals, fire, acts of God, or ordinary wear and tear. Additionally, this limited warranty does not cover scratches, topsheet chipping, or cosmetic blemishes, or indentations on the topsheets, sidewalls, edges, or bases, or improper drilling or mounting by a shop tech.
The damage replacement warranty does not cover intentional damage to skis. If at the end of a ski season, you intentionally break your skis so that we'll sell you another pair for $200, your warranty request will not be eligible. If you ski hard in the park or on the mountain and you blow out an edge or hit a rock so fast that it destroys your skis, those acts would allow you to make a claim under the damage warranty.
If you make a damage warranty claim and we allow you to purchase a replacement pair for $200, you will not be able to make any warranty claims on the replacement pair of skis.
Your Rights if a Product is Defective and Covered Under this Limited Warranty
ALL MANUFACTURING DEFECT WARRANTY CLAIMS WILL BE SUBJECT TO OUR SOLE, ABSOLUTE, AND NON-REVIEWABLE DISCRETION AS TO WHETHER THE CLAIM IS COVERED BY THIS LIMITED WARRANTY. IF WE DETERMINE THAT YOUR WARRANTY CLAIM IS COVERED, YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY BREACH OF THIS LIMITED WARRANTY IS THE REPAIR OR REPLACEMENT OF THE DEFECTIVE PRODUCT (OR DEFECTIVE PORTION OF THE PRODUCT) AT OUR COST, EXCEPT THAT YOU WILL BE RESPONSIBLE FOR THE SHIPPING COST TO RETURN THE PRODUCT TO US FOR REPAIR OR REPLACEMENT. NO CASH REFUNDS WILL BE ISSUED FOR ANY BREACH OF THIS LIMITED WARRANTY.
YOU WILL BE RESPONSIBLE TO PAY THE SHIPPING COST ON ALL DAMAGE REPLACEMENT CLAIMS TO HAVE THE REPLACEMENT SKIS SHIPPED TO YOU.
Disclaimer of Other Warranties
THIS LIMITED WARRANTY REPLACES ALL OTHER WARRANTIES. SPECIFICALLY, WE DO NOT WARRANT THE MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR PERFORMANCE OF ANY OF OUR PRODUCTS EXCEPT AS PROVIDED IN THIS LIMITED WARRANTY. WE HAVE NOT AUTHORIZED ANYONE TO MAKE ANY REPRESENTATION OR WARRANTY ABOUT THE PRODUCT EXCEPT AS PROVIDED BY THIS LIMITED WARRANTY, AND ARE NOT RESPONSIBLE FOR ANY SUCH UNAUTHORIZED WARRANTIES MADE BY SUCH PERSONS.
Your Assumption of Risk and Limits on Our Liability
BY USING OUR PRODUCTS YOU ACKNOWLEDGE AND AGREE THAT YOU ARE INTIMATELY FAMILIAR WITH AND HAVE CAREFULLY READ ALL WARNING LABELS, AND ALL WRITTEN TERMS AND CONDITIONS RELATED TO EACH PRODUCT PURCHASED FROM US. YOU FURTHER ACKNOWLEDGE AND AGREE THAT YOU UNDERSTAND THE SAFETY HAZARDS, RISKS, DANGERS, AND POTENTIAL FOR DAMAGE ASSOCIATED WITH USE OF THE PRODUCT. TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY ASSUME ALL OF THE RISKS AND DANGERS ASSOCIATED WITH USE OF THE PRODUCTS, AND FOREVER RELEASE, WAIVE AND DISCHARGE US, OUR AFFILIATES, SUBSIDIARIES, OWNERS, AGENTS, REPRESENTATIVES, AND EMPLOYEES FROM ANY AND ALL LIABILITY FOR LOSS OR DAMAGE, AND FOR EVERY CLAIM OR CAUSE OF ACTION OF ANY KIND INCLUDING, BUT NOT LIMITED TO, BODILY INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF YOUR USE, OR MISUSE OF ANY PRODUCT WE SOLD TO YOU. TO THE EXTENT PERMITED BY APPLICABLE LAW, WE ARE NOT LIABLE TO YOU OR ANY OTHER PERSON FOR INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES RELATED TO ANY DEFECTIVE PRODUCT, OR YOUR OR YOUR AGENT’S IMPROPER INSTALLATION, IMPROPER MAINTENANCE, OR YOUR, YOUR AGENT’S, OR YOUR GUEST’S MISUSE OF ANY PRODUCT, OR ARISING FROM ANY CAUSE OF ACTION WHATSOEVER,
INCLUDING CONTRACT, WARRANTY, STRICT LIABILITY, OR NEGLIGENCE, EVEN IF WE HAVE BEEN NOTIFIED OF THE POSSIBILITY OF SUCH DAMAGES, AND UNDER NO CIRCUMSTANCES WILL WE BE LIABLE TO YOU IN EXCESS OF THE AMOUNTS YOU PAID FOR THE PARTICULAR PRODUCT RELATED TO THE LIABILITY IN QUESTION.
How to Make a Claim
If you believe you have a claim covered under this Limited Warranty, please send us an email to dan@bluehouseskis.com containing your name, subject line “Warranty”, your order number, the product you purchased, a description of the defects to your product, and at least one picture showing the defect (if possible). When you claim is approved, please return the product (postage prepaid) to the address below:
